The Freedom of Information Act (FOIA) was enacted in 1967 by the US Congress to allow full or partial disclosure of government records upon request. The FOIA is in effect at the federal level, while states have enacted varying laws governing access to public records.
The Kentucky Revised Statutes (KRS) 61.870 to 61.884, known as the Kentucky Open Records Act (KORA), governs access to public records in the state. The Kentucky Open Records Act allows the public to have access to public records at all government agencies in the state except those exempted from disclosure.
In the City of Danville, the City Clerk ensures all City records are maintained properly and that all requests for open records receive a prompt response.
In addition to these duties, the City Clerk, a position appointed by the Danville City Commission, will ensure the City of Danville adheres to additional statutes, such as the Open Meetings Act (KRS 61.805 thru 61.850), setting agendas and properly recording minutes and, ensures City Ordinances are maintained and codified.
On March 16th, when we celebrate the Freedom of Information Act, we must also celebrate those, like our City Clerk, who ensure transparency and accountability in our local governments.
